BACKGROUND OF THE PROBLEM
Equality between women and men is a fundamental value, goal and driver of economic growth of the European Union. Not only in legal documents, but also in all activities, the European Union strives to promote equality between men and women. In line with the enlargement policy, candidate and potential candidate countries are expected to fully align with the EU acquis and standards in the area of social policy and employment before accession to the EU. Through the Instrument for Pre-accession Assistance (IPA), the EU also provides financial support for promoting quality employment and supports the effective implementation of rules and standards in the field of labor law throughout the region.
The 2022 Bosnia and Herzegovina Report states, among other things, that labor laws, which are in force at the entity level and in the Brčko District, and which apply to all employees except civil servants, guarantee a minimum level of protection of employees’ rights, and emphasizes that, in order to fully meet EU standards, the legal framework requires further improvement,
especially with regard to the protection of workers from discrimination. In addition, it is stated that
labor laws are not implemented properly, especially when it comes to social
dialogue, worker protection and labor inspection.
Although women in Bosnia and Herzegovina make up 50.9% of the population (compared to 49.1% men), their participation in paid work is significantly lower. The Agency for Gender Equality of BiH states that there is a “visible wage gap between men and women – hourly wage differences are estimated at 9% to the detriment of women”. Girls and women are often exposed to direct discrimination in employment – they are asked inadmissible questions about family planning and possible pregnancy. Likewise, 40% of women are exposed to some form of sexual harassment at work. Women in the labor market face multiple discrimination (including, but not limited to, sexual harassment, underpayment, reduction of maternity rights, etc.) and do not have easily accessible institutional support or a mechanism for protection against discrimination on the basis of sex. Business entities do not implement positive BiH legislation in the field of gender equality and protection against discrimination, and the controls of relevant inspections (i.e. labor inspection) are insufficiently effective.
OBJECTIVE OF THE PUBLIC CALL
The general objective of this project for the implementation period (2023-2025) is to contribute to reducing discrimination against women in the labor market by promoting and protecting women’s economic and social rights and strengthening the EU integration process.
